Welcome to www.luap.com.ph site (“Website”), an exclusive online community panel composed of the Life Underwriters Association of the Philippines (LUAP) members, hosted and operated by Life Underwriters Association of the Philippines.

Before using the Website, we enjoin the User (you) to please read these Terms of Use thoroughly and carefully. By accessing and using this Website, you are agreeing to comply with the Terms and Conditions and availing of the services offered. If, however, you do not agree with the Terms of Use, please do not use the Website and exit immediately.

Please also read our Privacy Policy found here which explains how user information is collected and may be used by Us and your use of the Website constitutes your acknowledgment and agreement to the Privacy Policy as well.

These Terms of Use may be changed and modified and your continuous use of the website constitutes your acceptance to any of the changes or revisions. When you fail to follow these Terms of Use, it will result to the suspension or termination of your access to the Website and in addition to other remedies available to Us

The website respects the intellectual property rights of others, and We ask our you to do the same.

You are not encouraged from submitting Items protected by copyright, trademark, patent, trade secret, moral right, or other intellectual property, personal, contractual, proprietary, or other third-party right without the express consent of the owner of such right. Liability resulting from failure to obtain the same consent or from any other injury resulting for the submitted content shall be borne solely by the you.

3. Application, Registration, and Security

Users who are LUAP members will be required to create an account. The Website is intended to be used for Users who are above the age of 18. We shall not intentionally gather personal information from users under the age of 18 and submission of these users of their personal information to Us is expressly prohibited and their submission of such info shall neither be used nor retained by Us.

You guarantee that the information provided are (a) true and complete; and (b) shall always be maintained and updated to kept true and complete. Should there be any reasonable ground to believe that the information provided is untrue and incomplete, the same shall result to the suspension or the termination of the your access to the Website and shall bar any future use of the Website or any portion thereof without any notice.

For the username and password upon registration, please choose a password that is secure and not easy for others to guess and regularly change the same for your personal safety.

The confidentiality of the username and password including the usage and activity of the your account, including but not limited to, use of the same mentioned details and accounts by another persons shall be your sole responsibility and you are not encouraged to authorize anyone else to have any knowledge of the same. Breach shall be a ground for suspension and termination of your account.

In cases when the you believe that your account has been compromised, We highly encourage that the password should be changed as soon as practicable and notify us of the issue.  In order to safeguard the Website and your account without limiting any rights, We reserve the right to take action We deem necessary and rational, including but not limited to, terminating the your account, changing the your password, or requesting additional information to authorize further activities in the account. Nonetheless, We may also depend on the authority of anyone accessing your account and in no event and under no circumstance shall We be held liable to you for any liability or damage resulting from or arising out of (i) any action or inaction on Our part under this provision, (ii) any compromise of the confidentiality of your account or password; and (iii) any unauthorized access of your account or use of your password

4. WHO MAY APPLY FOR LUAP MEMBERSHIP

LUAP membership is open to all life insurance professionals who passed the licensure exam administered by the Insurance Commission and all individuals who are affiliated or are employees of a life insurance company in the Philippines.

5. MEMBERSHIP

LUAP membership is on a calendar year basis and automatically expires every December 31 of the current year. Membership renewal is done starting January 1 of the following year.

The association, through its Board of Trustees, reserves the right to open membership renewal earlier than January 1 of the following year.

6. MEMBERSHIP FEE

Membership Fee shall be Php1,200 per applicant.

The association, through its Board of Trustees, reserves the right to give membership fee discounts at their own discretion.

7. REGISTRATION FEE

Registration Fee depends on the particular event.

The association, through its Board of Trustees, reserves the right to determine the registration fee per event, to whether or not allow bulk registrations, and to give registration fee discounts.

8. REGISTRATION AND PAYMENT

Submission on an online membership application and registration to an event are regarded as a firm membership application, registration to an event, and acceptance of these terms and conditions, however the registration will not be confirmed until full payment has been received. Payment in full must be received at the time of registration. In the event that the full payment is not received, the delegate will be refused entry to the conference.

Payment(s) through this Service may only be made with a Credit Card, Debit card or Net Banking, Mobile payment, Cash payment/OTC through GCash, 7eleven (7connect), ECPAY, BDO Over the Counter (BDOOTC), BDO Online Bills Payment (BDOOBP), Unionbank Online Bills Payment (UBPOBP), MLhuillier, Cebuana, PNB Online Bills Payment (PNBOBP), PNB Over the Counter (PNBOTC), SM Payment, UCPB Over the Counter (UCPBOTC), UCPB Over the Counter (UCPBOBP), Security Bank (SBCOBP), Bancnet IPG, Direct Agent 5, Expresspay
Truemoney, CLIQQ, POSIBLENET and BPI Online.

9. REFUND/CANCELLATION POLICY – MEMBERSHIP FEE

Membership Fees once paid will not be refunded under any circumstance. In the event that the Membership Fee was intended for a different person, at the fault of the applicant,  NOTICE shall be e-mailed to [email protected] and [email protected] attention to both MR. BRYAN BATERNA & MS. KIARA BATUIGFA with the following details:

In the vent of overage of Membership Fee Payment, NOTICE shall be e-mailed to [email protected] and [email protected] attention to both MR. BRYAN BATERNA & MS. KIARA BATUIGAS with the following details:

-Bank details where refund shall be deposited.

Note that the amount to be refunded shall be  the AMOUNT OF THE OVERAGE LESS WEBSITE ADMIN PROCESSING FEES. The lead time for refund processing shall be THIRTY (30) WORKING DAYS.

10. REFUND/CANCELLATION POLICY – REGISTRATION FEE

Registration Fee/s will only be refunded for CANCELLATIONS at least 24 hours before the event date.

Notice of cancellation/s shall be e-mailed to [email protected] and [email protected] attention to both MR. BRYAN BATERNA & MS. KIARA BATUIGAS with the following details:

Note that the amount to be refunded shall only the be amount of the Registration Fee and shall not include charges of website admin and processing fees. The lead time for refund processing shall be THIRTY (30) WORKING DAYS.

11. SUBSTITUTIONS

Substitutions may be only allowed when cancellation is made at least 24 hours before the event date following prior provision.

12. Media

The User may upload a profile photo. Images that can be uploaded are those with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

13. Contact forms

The User may use the contact forms provided in the Contact Us section of the Website. By filling-out the form, We reserve the right to collect, store and use data provided.

14. Cookies

If the User leaves a comment on the Website, User may opt-in to saving personal details in cookies. These are for the User’s your convenience so that there will be no need to fill in the same details again. These cookies will last for one year.

If the User has an account and logs in to this Website, we will set a temporary cookie to determine if the User’s browser accepts cookies. This cookie contains no personal data and is discarded when User closes the browser.

You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Data collected via this Website shall be kept with utmost confidentiality and shall in no case be sent to anyone or anywhere. The only exception is when the respective company requests for your attendance to the events we hold. The data shall only be sent via e-mail to the authorized representative of your company.

Contact information collected via this Website shall be kept with utmost confidentiality and shall in no case be shared to anyone.

21. How We Protect Your Data

The data collected via this Website are all stored online and handled by 2 authorized Front Office personnel.

22. What Data Breach Procedures We Have In Place

The data collected via this Website shall be stored online and the same also has a log-in history feature where We will be able to know the access history of the database. In the event of breach, access to this database shall be a automatically disabled and issue shall be raised to Our Website Developer for investigation of the breach. 

23. What Third-Parties We Receive Data From

We also receive details of LUAP membership applications from authorize representatives from insurance companies who sponsor their financial advisors LUAP members fee. The details provided by the authorized representatives are deemed true and complete once submitted to Us.

24. What Automated Decision-Making and/or Profiling We Do With User Data

The data gathered shall be used for analysis purposes on the status of membership per insurance company, on the demographics of members and on making targeted events for a specific group of members.

25. Industry Regulatory Disclosure Requirements

We strictly comply with Republic Act 10173 or the Data Privacy Act of 2012.

26. Choice of Law; Jurisdiction and Venue

These Terms of Use shall be construed in accordance with the laws of the Republic of the Philippines. Any legal proceeding against Us in any way related to our Website shall be brought exclusively in the appropriate courts of Makati City to the exclusion of any other court.

27. Indemnification

In any and all claims and liabilities, including but not limited to attorney’s fees, arising from any content or post by you to though this Website or from your unauthorized of any item taken from this Website, or any breach of these policy shall cause you to indemnify LUAP and our affiliates, employees, agents, representatives, and third party service providers, and to defend and hold each of them harmless from any and all claims and liabilities.

By using this Website, you are fully aware that you are using this Website at your own risk and you hereby agree to release LUAP, its Directors, Officers, Empoyees and Agents from any claim, demand and damages of whatever nature and kind whether known or unknown, disclosed and undisclosed arising out or in any way related to the use of this Website.
